a potential employee if they can provide proof of auto liability insurance ? and the only reason i asked is a past experience where a employee back into a customers car in there parking lot and couldn't produce...so you see where this gos.right back to me.not one day later i get a call from some agency saying it was unlawful for me to ask this question...i wont go into long drawn out details but..how bout some input ?

if they are useing their personal vehicle for use on the job your insurance should cover it..if they are contract labor then their insurance should cover it..as far as asking..if they work for you and are nice enough to use their own vehicle for work then add to your ins and save the hassle..

good question, how can they hold you responsible for an employee, was he/she making a delivery or other job related work at the time

I have been asked to provide a copy of insurance before while driving on company property

I think rebelangler hit it on the head. If they are nice enough to use their own vehicle, they should additionally be paid for mileage.

Putting it in a different context, if that employee is working for you and gets cited for speeding during business hours; who's record does it go on? It is against the law now to not carry insurance (not sure how long ago that employee hit your customers car) so they are liable for their car, you could have civil charges from this but a parking lot fender bender is probably small. The thing to realize here is the business factor...by picking up the pieces with the customer will it be prosperous later.

as long as your questions can't be construed as being potententially discriminatory in nature - having a basis on sex, color, creed, religion, ethnicity, blah, blah, blah - i think you can ask any questions you feel are appropriate.

I think of it like this: would that employee have been at that place and time if they weren't doing something for you as a part of their job? If not, they're having to soak up added risk exposure for your benefit. I think every car insurance form I've ever seen has had a question as to whether or not the vehicle is used for work; I don't remember ever having to check "yes", but I'd imagine the rates would go up based on that added exposure. Who is paying for that increase, and who gets the benefit of that added exposure?

You can say pretty much whatever you want as long as it is just you and another person hearing this conversation. Verbal threats and harassment are very hard to prove when there is not a third party to sustain what was said. Before anyone gets their fur rubbed the wrong way the reason I know this is that my management at my workplace say a lot of things that should not be said in the workplace according to some laws. The kicker is that they know verbal abuse is almost impossible to prove without a witness. When regional management is brought into the loop they have a few words the offending person and try to calm whoever got their feelings hurt. I was a bit intimidated at first till I figured out how this works and now I just let 'er rip when i am in the bossman's office with the door shut. If he can be a foul mouthed,harrasing POS so can I. Some day it may bite me but until then I'm gonna have some fun with it. Back to the original question. If they can't prove you asked them I would just play dumb if anyone was asking questions. IMO they are just fishing. My .02 YMMV.I re-read my post and realized that I made it sound as if you were doing something discriminatory. Bad choice of words,that was not my intent. Sorry

I have several guy's who drive their own trucks and I pay them mileage. They must have their own liability insurance. They are also covered on mine while on company business.
