can i shoot deer on my own property, even though i have about 3 1/2 acres? i plan on using a centerfire rifle, during the regular season, during regular hunting hours. we live out in the country, and there are 3 houses within visual distance. the bullet will go into the ground after it exits the deer. i know that this is a very stupid quesiton, but i was told, by someone in another state, that i might not be able to. i am not in the city limits by any means.
A while back I have heard of a 10 acre rule. You could prolly get away with it if such a rule was in place. I have deer on my place but have a lease to shoot them. Remember if such a law is true, you have to put the ranch name on the tag.
PLEASE DO ASK. i really do need an answer to this ASAP!!! i put up a feeder last sunday, and deer started coming to it by monday evening. this evening, i had 8, yes 8 deer under it... there is a pretty large buck that has rubbed 5 of the 10 fruit trees we've planted and has even pulled one right out of the ground, so, it's a matter of protecting our fruit trees as well as putting some high protien, low fat meat in the freezer.
Do you know the neighbors? How do they feel about it? Up in the panhandle we shoot mule deer out of wheat fields and you can see houses but no one up there cares.
if you do not make a living off fruit trees you can not use depredation as a defence. I have a friend that has a few lots in New Brunfels and the deer eat from the flower beds and he is out of the city limmits. I will ask in the am and will answer ASAP.

Comal County has a 10 acre rule, so does Medina County. I've been wanting to hunt on my buddy's place near Bulverde for years but it is only 5 acres.
You need to check with the county you live in. Any of your local LEO's should be able to answer, if not the county judge. I don't think that TPWD has a rule for that, but it would be good to know from a Game Warden.

BUT, from the way I read it he has to be in a platted subdivision with lots less than 10 acres to not be able to hunt, if you are not in a "subdivision" the you are good to go, granted there are no county ordinances
Got the poop on this and it is iffy so be cautious please, the answer is in 80% of Texas NO and if you live within 4 hours of the Gulf of M then NO, you can not discharge a firearm, airgun, or arcery on less than 10 acres, excluding indoor firing ranges and city county aproved firing ranges. This is passed on to City UTJ and County law, for some kind of control for urban sprall. With the uncertanty of how the said city / county would look at you making a kill, they may get you for cruelty to animals Felany or unlawful discharge of a fire arm Class C misdemeanor. Use good judgement, you can get in trouble if caught. Here in the woods where there are more people than teeth, where I live everyone shoots. I guess it is one of those laws they may choise to use only when nessassary, who knows.
